The plain-English terms for working with us — packages, payments, the Care Plan and your rights.
These Terms of Service (“Terms”) govern your use of sitiala.com and the services provided by Sitiala (“Sitiala,” “we,” “us” or “our”), part of Atomica Team. By using our site or hiring us, you agree to these Terms.
By visiting our website, booking a call, or purchasing a package or add-on, you confirm that you are at least 18 years old and able to enter into a contract, and that you accept these Terms. If you don’t agree, please don’t use our services.
Sitiala designs, builds, launches and maintains websites for small businesses, and offers optional add-ons such as booking systems, online stores, online payments, a client area and copywriting. The specific deliverables depend on the package or quote you accept.
Our packages list what’s included at a fixed price. Work outside that scope (extra pages, features, or revision rounds beyond those included) may require a new quote. Delivery timelines we share are good-faith estimates and depend in part on receiving your content and feedback on time. Included revision rounds are described on each package; additional changes may be billed separately or covered by the Care Plan.
Prices are shown in U.S. dollars (USD). One-time package fees are charged through Stripe, our payment processor, by card. By paying, you authorize the charge and agree to Stripe’s terms. Because Sitiala is part of Atomica Team, that name may appear on your statement or receipt. You are responsible for any applicable taxes. We typically begin work once payment (or an agreed deposit) is received.
The Care Plan is an optional monthly subscription that may include hosting, SSL, backups, monitoring, support and a set number of content changes per month. It is billed automatically each month through Stripe until you cancel. You can cancel anytime; your plan stays active through the end of the current billing period, and you won’t be charged again after that. Unused monthly changes don’t roll over.
Our work is custom and begins promptly, so fees are generally non-refundable once work has started. If you cancel a project before any work begins, we’ll refund what you paid, minus any work already performed or third-party costs incurred. Care Plan payments are not refundable for the current month, but you can cancel future renewals at any time. Nothing here limits rights you may have under applicable consumer-protection law.
Your domain name and professional email are not included in the packages or Care Plan and carry a separate cost paid directly to the provider. We help you register and set them up, and they remain registered in your name and owned by you.
You agree to give us accurate information and the content we need (text, images, logos) in a timely way, and to review and approve work when asked. You confirm that you own or have the rights to everything you provide, and that it doesn’t infringe anyone else’s rights or break any law. You’re responsible for the lawful operation of your business and the products or services you sell through your site.
Once your project is paid in full, you own the final website and the custom content we created for it. Until then, all work remains our property. We may retain rights to underlying tools, code libraries, frameworks and general know-how we reuse across projects. Unless you ask us not to, we may display your finished site and its name in our portfolio and marketing as an example of our work.
Your site may rely on third-party services such as Stripe, Google, hosting providers and booking tools. Those services have their own terms, and we’re not responsible for their availability, changes or outages. We’ll do our best to choose reliable providers and help if issues come up.
We put real care into our work, but our services and website are provided “as is” without warranties of any kind, express or implied, beyond what the law requires or what we agree to in writing. We don’t guarantee specific business results, search rankings, traffic or sales, since those depend on many factors outside our control.
To the fullest extent permitted by law, Sitiala and Atomica Team won’t be liable for indirect, incidental or consequential damages, or for lost profits or data. Our total liability for any claim relating to our services is limited to the amount you paid us for the specific service giving rise to the claim.
These Terms are governed by the laws applicable where Sitiala operates (Guatemala), without regard to conflict-of-law rules, except where a mandatory consumer-protection law of your place of residence applies. We’ll always try to resolve any concern with you directly and fairly first — just reach out.
We may update these Terms from time to time. When we do, we’ll update the “Last updated” date above. Continuing to use our services after changes means you accept the updated Terms.
